These terms are legally binding you and wherever applicable, on your successors, executors, administrators, managers, beneficiaries, legal representatives, agents and legal heirs and contain important information regarding your rights and obligations,

IGI Life is willing to sell fitness devices to you through this site only if you agree to these terms and conditions. By clicking on the “I Accept”, you automatically agree to be bound by all of these terms and privacy policy.

By agreeing to these terms and conditions, you declare and confirm that the debit/credit card to be used belongs to you, that is, by opting for fitness device payment through debit/credit card, payment must be made only through the debit/credit card issued in your name.

You are aware of the fact that besides the email and SMS confirmation, no other receipt of online payments will be sent by post. The confirmation email should be kept secure for any future correspondence.

IGI Life Insurance Limited may alter, amend or modify these terms at any time without notice and the same shall be binding upon you and the Company shall have no liability of any nature in relation to this.

The laws of Pakistan exclusively govern these terms and conditions and all matters related to the fitness device payment. All disputes shall be subject to the exclusive jurisdiction of the Courts of Pakistan at Karachi.

LIMITATION OF LIABILITY

 Your access to and use of the website is at your own risk.  The website and content is provided on an “as is” and “as available” basis without any representations, warranties or conditions of any kind, whether express or implied, and including without limitation implied representations, warranties or conditions of or related to accuracy, accessibility, fitness for a particular purpose, merchantability, performance or durability, all of which are disclaimed by Order.pk/IGI Life to the fullest extent as permitted by law.

Please note that the online payment through the Payment Gateway is not from the IGI Life server and that you are going to a non-IGI Life website. IGI Life Insurance Limited is not responsible for, shall have no liability for and disclaims all warranties whatsoever, expressed or implied, related to the site, including without limitation any warranties related to performance, security, stability or non-infringement of title of the site (including site content) or any controls downloaded from the site.

This website may be linked to other websites which are not maintained by IGI Life Insurance Ltd. and the Company is not responsible for the content of such websites. The inclusion of any link to such websites does not imply IGI Life’s approval or endorsement of such sites or the content thereof. Moreover, the sites pointed at by links have been independently developed and possibly maintained by person(s) over whom the Company has no control.

IGI Life assumes no responsibility for the content of any site referenced to by any hyperlink or otherwise. The Company believes that our making available links to publicly accessible web pages is legally permissible and consistent with the common, customary expectations of those who make use of the Internet.

ORDER, PRICE AND PAYMENT

Please review your order carefully before you place it.

After having received your order, we will send you a confirmation call/email with your order number and details of the items you have ordered.

Only valid orders having accurate membership numbers will be accepted by us or we will not be obligated to sell the fitness devices to you.

The price for the products is as indicated on the face of this Order,

All prices posted on this site are subject to change without notice. The price charged for a fitness device will be the price in effect at the time the order is placed and will be set out in your order confirmation email.

Posted prices do not include taxes or courier charges. All such taxes and charges will be added to your merchandise total and will be itemized in your shopping cart and in your order confirmation email. For avoidance of doubt, the Site does not have a price match guarantee, and we will not match the advertised price other retailers offer for the same items.

You represent and warrant that (i) the credit card information you supply to us is true, correct, and complete, (ii) you are duly authorized to use such credit card for the purchase, (iii) charges incurred by you will be honored by your credit card company/ bank,(iv) you will pay charges incurred by you at the posted prices, including all applicable taxes, if any, and (v) you authorize Order.pk to charge you for any fitness device purchased using your payment method.

EXCHANGE AND REFUND POLICY

All fitness devices once sold are non-refundable.  No cash refunds, returns of a product or any exchanges except the Exchange mentioned herein will be allowed.

Exchange for the purposes of these Terms of Use shall mean the provision of a substitute but identical unit of the same model and description as was originally purchased/delivered unless for some unforeseen reasons the replacement is not available (“Exchange”).

In addition to rights you may have under applicable law, you may request to Exchange the product with an identical product within seven (7) Days from the date you receive it if:

 2.1  the product is accompanied by all original packaging, manuals, accessories, free items and other components or parts that accompanied the product when it was delivered; and

 2.2    the product is dead or otherwise suffers from a manufacturing defect, noticed upon delivery.

 Subject to applicable law, Exchange requests made after seven (7) days period will not be accepted.

Purchases with original packing will be entertained and exchanged within six (6) working days of receiving the exchange request.   

The item should be in a saleable condition. If a product is returned to us in an inadequate condition, we reserve the right to send it back to you.

SHIPMENT, DELIVERY AND RISKS INVOLVED

If you refuse or fail to receive the delivery of your fitness device, any risk of loss or damage to the devices shall nonetheless pass to you, and without prejudice to any other rights or remedies we have, we will remain entitled to payment in full for the delivered device.

APPLICABLE LAWS AND DISPUTE RESOLUTION

Please note that IGI Life is neither liable for any issues arising from the sale of the products to you by the seller nor for the warranty services which are to be provided by warranty service providers.

The purchase/order and any dispute, controversy, or claim arising out of, relating to, or in connection with this order shall be governed by the applicable Laws of Pakistan.

Both parties shall attempt in good faith to amicably resolve any controversy, claim or dispute (of whatever nature arising, including but not limited to those arising out of or relating to these T & C’s or the construction, interpretation, performance, breach, termination, enforceability or validity thereof (or the commercial, economic or other relationship of the parties hereto) whether such claim is based on rights, privileges, or interests recognized by or based upon statue, contract, tort , common law, or otherwise and) whether such claim existed prior to or arises on or after the date of this order (the "Dispute"), through amicable negotiation between the authorized officers of both Parties.

In the event that the parties are unable to resolve a dispute through amicable negotiations and in the normal course of business within forty-five (45) days of such a dispute arising, the Parties shall refer the dispute to arbitration in accordance with the Arbitration Act 1940. The arbitration proceedings shall be chaired by a sole arbitrator, mutually appointed by the Parties. The language of the proceedings shall be English and the place of arbitration shall be in Lahore. The award of the arbitrator shall be binding on both Parties.

FORCE MAJEURE

In the event of force majeure, strike, riot, civil commotion, war, epidemic, quota, embargo or other causes or circumstances beyond the control of IGI Life or its vendor, which affects completion of this Order by seller, seller may cancel this Order or postpone shipment without any liability.

PATENT AND TRADEMARKS

Some trademarks, service marks, trade names, logos, and icons on the website are proprietary to IGI Life Insurance Limited.  Nothing contained on this website should be construed as granting, by implication, estoppel, or otherwise, any license or right to use any trademark displayed on this website. Your use of the trademarks displayed on this website, or any other content on this website, except as provided herein, is strictly prohibited. Images displayed on this website are either the property of IGI Life or the website operated for online premium payment facility through the Payment Gateway. Any unauthorized use of images may violate copyright laws, trademark laws, the laws of privacy and publicity, and communications regulations and statutes.
